Thank you for booking with Galway Rafting. Please read these Terms & Conditions carefully before participating.

1. Booking & Agreement

By making a booking with Galway Rafting, you agree to these Terms & Conditions, the Galway Rafting Participant Waiver & Safety Declaration, and all safety instructions provided by Galway Rafting.

These Terms & Conditions apply to all guided rafting activities provided by Galway Rafting.

These Terms & Conditions are governed by the laws of Ireland. Nothing in these Terms & Conditions excludes or limits any statutory rights or liability that cannot lawfully be excluded or limited.

2. Nature of the Activity & Inherent Risks

Rafting and water-based activities involve inherent risks. These may include:

• Falling from or capsizing the raft;

• Cold-water immersion, hypothermia and accidental ingestion of water;

• Slipping on wet surfaces;

• Contact with the raft, paddle, riverbank or other objects;

• Contact with submerged or partially submerged debris, including glass or other sharp objects;

• Underwater obstacles, currents and eddies;

• Changing river conditions;

• Entrapment or separation from the group;

• Actions of other participants;

• Equipment failure or malfunction;

• Physical exertion;

• Waterborne illness;

• Serious injury; and

• Drowning.

Participants must read and accept the Galway Rafting Participant Waiver & Safety Declaration before participating.

Participants voluntarily accept the inherent risks associated with the activity. Nothing in these Terms & Conditions or the Participant Waiver excludes or limits liability that cannot lawfully be excluded or limited.

3. Health, Fitness & Medical Conditions

Participants must be physically capable of participating safely.

The maximum participant weight is 110 kg / 242 lbs. Participants exceeding this limit cannot participate.

Participants must inform Galway Rafting before the activity of any health condition, pre-existing or recurring injury, medication, physical limitation or other circumstance that could affect their ability to participate safely.

Participants are responsible for bringing any medication they may need.

Galway Rafting may refuse participation where a participant is not considered fit or able to participate safely.

4. Swimming & Water Safety

All participants must be able to swim.

Participants must follow all swimming and water-safety instructions given by Galway Rafting staff.

Participants may only enter or swim in the river when instructed or permitted by Galway Rafting staff and only in designated safe areas.

Participants must remain with the group unless instructed otherwise by a guide.

5. Water Quality & Waterborne Illness

The River Corrib is a natural river environment and may contain microorganisms, bacteria, parasites or other contaminants that may cause illness or infection.

Participants acknowledge the potential risk of waterborne illness, including leptospirosis and other illnesses associated with natural waterways.

Swallowing river water may increase the risk of illness. Participants should avoid deliberately swallowing river water and follow all hygiene and safety instructions.

6. Safety Briefing & Equipment

A safety briefing and/or safety video will be provided before participation.

Participants must pay attention to and follow all safety instructions given by Galway Rafting guides and staff.

Galway Rafting provides the rafting and safety equipment required for the activity.

Participants must use equipment only as instructed and must not deliberately misuse or interfere with safety equipment.

Any injury, illness, distress, equipment defect or safety concern must be reported immediately to a guide.

7. Alcohol, Drugs & Prohibited Items

Participants must not be under the influence of alcohol or drugs and must not have consumed either within the 24 hours before participating.

Alcohol and drugs are prohibited during the activity.

Smoking is prohibited on the rafts.

Glass bottles, knives, fishing equipment and other items considered unsafe by Galway Rafting are prohibited.

Participation may be terminated without refund where these requirements are breached, subject to applicable law.

8. Clothing & Personal Belongings

Participants must wear suitable enclosed footwear that can get wet and appropriate sports clothing.

Participants should bring a waterproof jacket, warm change of clothes and a towel.

Personal belongings are brought at the participant's own risk. Galway Rafting cannot guarantee that storage containers are completely waterproof and recommends waterproof cases for phones and electronics.

Galway Rafting is not responsible for lost or water-damaged belongings, subject to liability that cannot lawfully be excluded.

9. Personal Accident & Travel Insurance

Galway Rafting recommends that participants obtain appropriate personal accident and/or travel insurance covering participation in rafting and water-based activities.

Participants should check that their insurance specifically covers the activity and level of rafting they are undertaking, including higher river conditions where applicable.

Participants are responsible for determining whether their insurance provides adequate cover for their individual circumstances.

The recommendation to obtain insurance does not limit or exclude any liability that Galway Rafting cannot lawfully exclude or limit.

10. Participant Conduct & Responsibilities

Participants must behave responsibly, follow all safety instructions and must not deliberately place themselves or others at unnecessary risk.

Participants must immediately tell a guide if they become unwell, injured, distressed or unable to continue safely.

Participants may be responsible for reasonable costs resulting from intentional or negligent damage to Galway Rafting equipment, subject to applicable law.

11. Emergency Assistance

Participants understand that accidents, injuries and medical emergencies can occur during rafting and water-based activities.

Where reasonably necessary, Galway Rafting staff may provide reasonable assistance and contact the emergency services.

Participants must cooperate with emergency instructions.

12. Age & Supervision

Participants must be over 6 years old unless otherwise specified for a particular activity.

A minimum of two adults per private raft is required.

All minors must be accompanied by an adult in accordance with Galway Rafting's safety requirements.

If the required supervision is not available, the trip cannot proceed.

13. Hen & Stag Parties

Hen and stag parties are not permitted on Public Rafting Trips and must book a Private Rafting Trip.

If a group is found to be a hen or stag party after booking a Public Rafting Trip, Galway Rafting may cancel the booking without a refund.

14. River Conditions & Nature of the Experience

The River Corrib is a natural environment and conditions can change.

Water levels, flow, weather, water temperature and other conditions may affect the activity.

Galway Rafting may alter, shorten, postpone or cancel an activity where conditions are unsuitable or unsafe.

The River Corrib offers a gentle experience suited to families and beginners. Trips may involve flat-water paddling rather than white water.

White water cannot be guaranteed.

15. Late Arrival & Service Refusal

Participants must arrive at the designated meeting point at the time stated in their booking.

Galway Rafting works to a schedule and cannot normally wait for late participants. Late arrival may result in the participant or group being unable to participate, particularly where waiting would affect the safety, schedule or experience of other participants.

Where a participant or group arrives too late to participate without causing unreasonable disruption to the scheduled activity, Galway Rafting may refuse participation without refund, subject to applicable law.

Galway Rafting also reserves the right to refuse or terminate participation where a participant:

• Is under the influence of alcohol or drugs;

• Has consumed alcohol or drugs within the previous 24 hours;

• Does not meet age or swimming requirements;

• Is not considered fit to participate safely;

• Does not have suitable clothing or footwear;

• Has failed to disclose relevant information affecting safe participation;

• Refuses to follow safety instructions;

• Behaves dangerously, abusively or threateningly; or

• Creates a safety risk to themselves or others.

Where participation is refused or terminated for these reasons, no refund will normally be provided, subject to applicable law.

16. Disabilities & Additional Support Needs

Participants, parents, guardians, carers or booking organisers must inform Galway Rafting before the activity of any disability, medical condition, mobility limitation, communication difficulty, behavioural consideration, learning difficulty or other additional support need that may affect safe participation or require additional assistance.

This information should be provided at the time of booking where possible.

Providing information about a disability or additional support need does not automatically prevent participation. Galway Rafting will consider whether the activity can be safely provided with reasonable adjustments or additional support.

Where a participant requires a carer or support person, that person must be present and able to provide the required assistance throughout the activity unless otherwise agreed with Galway Rafting in advance.

The parent, guardian, carer or authorised representative providing consent on behalf of another participant confirms that they have authority to do so and that the information provided is accurate and complete to the best of their knowledge.

Where Galway Rafting reasonably determines that an activity cannot be safely undertaken with the available equipment, staffing or reasonable adjustments, participation may be refused or an alternative arrangement offered.

17. Customer Cancellations

Customer cancellations must be made at least 3 days before the booked activity.

Cancellations made less than 3 days before the activity are not eligible for a refund, subject to any rights available under applicable law.

All cancellation or amendment requests must be made through the booking method specified by Galway Rafting.

18. Cancellation by Galway Rafting

Galway Rafting may cancel, postpone, reschedule or modify an activity due to unsafe weather, unsuitable river conditions, safety concerns, operational requirements or circumstances beyond our reasonable control.

Where Galway Rafting cancels an activity, an appropriate remedy may include a full refund, rescheduling or voucher, subject to applicable law.

19. Circumstances Beyond Our Reasonable Control

Galway Rafting is not responsible for delays, changes or failure to provide an activity caused by circumstances beyond our reasonable control, including extreme weather, unsafe river conditions, natural events, emergencies or changes to access.

This does not affect any statutory rights or liability that cannot lawfully be excluded.

20. Liability

Galway Rafting does not seek to exclude or limit any liability that cannot lawfully be excluded or limited.

Participants remain responsible for their own actions, behaviour and compliance with safety instructions.

Nothing in these Terms & Conditions or the Participant Waiver affects statutory consumer rights or legal remedies.

21. Photography & Video

Galway Rafting may take photographs and/or video footage during activities for promotional, marketing, social media and other legitimate business purposes.

Where identifiable images or video of participants are intended to be used for promotional or marketing purposes, Galway Rafting will obtain the appropriate consent.

Participants may inform Galway Rafting before the activity if they do not wish to be photographed or filmed for promotional purposes.

Parents, guardians or authorised representatives may provide or withhold consent on behalf of minors or participants for whom they are authorised to provide consent.

Consent for promotional photography or video is separate from acceptance of these Terms & Conditions and is not a condition of participation.

22. Minors & Participants Requiring Assistance

A parent, legal guardian or authorised carer/representative must provide the required consent for a minor or participant unable to provide consent themselves.

The responsible adult confirms that the participant has no undisclosed health condition or injury that would prevent safe participation and accepts responsibility for their supervision and conduct.

All responsible adults must be sober and capable of providing the required supervision or assistance.

23. Data Protection

Personal information will be handled in accordance with applicable data protection legislation and Galway Rafting's Privacy Policy.

Personal information will only be used and disclosed as permitted by applicable law.

24. Changes to These Terms

The version of the Terms & Conditions in force when the booking is made applies to that booking.

Galway Rafting may update these Terms & Conditions for future bookings where necessary.

25. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

Nothing in this section prevents a consumer from exercising any legal rights or remedies available under applicable law.

26. Agreement

By completing a booking and accepting these Terms & Conditions and the Galway Rafting Participant Waiver & Safety Declaration, you confirm that you have read and understood the information provided and agree to comply with Galway Rafting's requirements and safety instructions.

Galway Rafting – Privacy Policy

At Galway Rafting, we take the privacy and security of our customers' personal information seriously. This Privacy Policy explains what personal information we collect, why we collect it, how we use it, who we may share it with, and your rights under applicable data protection law, including the General Data Protection Regulation (GDPR).

Payment information may be processed directly by the relevant payment provider. Galway Rafting does not normally have access to complete payment card details.

• Communicate with you regarding your booking;

• Provide the activity and appropriate safety arrangements;

• Assess information relevant to safe participation;

Where we process information concerning health, disability or other potentially sensitive information for safety purposes, additional GDPR requirements may apply.

5. Health, Medical & Additional Support Information

Some participants may provide information about medical conditions, injuries, disabilities, medication or additional support needs because this information may be relevant to safe participation.

We only request or use such information where reasonably necessary for safety, participation arrangements, emergency response, legal obligations or the protection of participants and others.

Where such information constitutes special-category personal data under GDPR, Galway Rafting will process it only where an appropriate legal condition under applicable data protection law applies.

Participants should provide only information that is relevant to their safe participation.

6. Emergency Contacts

Where we collect an emergency contact or next-of-kin's details, the information is used to contact that person where reasonably necessary in connection with an emergency or serious incident.

Customers should ensure that the person provided as an emergency contact is aware that their contact details have been provided to Galway Rafting.

7. Booking Platforms, Service Providers & Data Sharing

Galway Rafting uses selected third-party service providers to operate its business and provide services to customers.

These may include:

• FareHarbor for booking and reservation management;

• Payment providers for processing payments;

• Google Workspace and other email or cloud-storage services;

• Website and hosting providers;

• Communication and marketing services; and

• Professional advisers, insurers or other service providers where reasonably necessary.

These providers may process personal information on behalf of Galway Rafting or independently where they have their own legal responsibilities.

We do not sell customer personal information.

We only disclose personal information where reasonably necessary for providing our services, complying with legal obligations, protecting our legitimate interests, responding to emergencies, or where otherwise permitted or required by law.

8. International Data Transfers

Some of the service providers we use may process personal information outside the European Economic Area (EEA).

Where personal information is transferred outside the EEA, Galway Rafting will seek to ensure that an appropriate legal safeguard is in place in accordance with applicable data protection law.

9. Marketing Communications

If you choose to receive marketing communications from Galway Rafting, we may send you information about activities, news, offers and other relevant updates.

You can withdraw your consent or unsubscribe from marketing communications at any time by using the unsubscribe facility provided or contacting GalwayRafting@gmail.com.

Withdrawing marketing consent does not affect the lawfulness of processing carried out before consent was withdrawn.

10. Photography & Video

Galway Rafting may take photographs and/or video footage during activities.

Where identifiable photographs or video are intended to be used for promotional or marketing purposes, we will obtain appropriate consent where required.

Marketing photography/video consent is separate from consent to participate in the activity.

If you do not wish to appear in promotional photographs or video, you can notify Galway Rafting before the activity.

11. Data Security

Galway Rafting takes reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access to customer information is restricted to persons and service providers who reasonably require it for legitimate business purposes.

However, no method of electronic storage or transmission can be guaranteed to be completely secure.

12. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected.

Different types of information may be retained for different periods.

Booking, financial, insurance, incident and other business records may need to be retained for longer periods where required by law, accounting requirements, insurance requirements or the establishment, exercise or defence of legal claims.

Marketing information will be retained in accordance with applicable marketing and data-protection requirements.

When information is no longer required, it will be securely deleted or otherwise disposed of where reasonably practicable.
